Orange Send provides tools that allow merchants to send SMS and email communications to their customers. In addition, Orange Send may send limited SMS messages directly to merchants for account-related purposes such as service notifications, security alerts, and important platform updates.

These messages are transactional in nature and are not promotional. By providing your contact information, you acknowledge that such communications may be sent as part of your use of the Service.

You must obtain clear, informed, and verifiable opt-in consent from all recipients prior to sending SMS messages using the Service.
Consent to receive SMS messages must be obtained separately from acceptance of these Terms and cannot be a condition of using the Service.
All SMS messages sent through the Service must include clear opt-out instructions. Recipients must be able to opt out at any time by replying STOP.
Recipients may request assistance by replying HELP or contacting your business directly.
You are responsible for maintaining records of consent and ensuring compliance with all applicable messaging laws and carrier requirements. Orange Send does not verify consent and is not responsible for unauthorized messaging.
Consent must be obtained through a clear and conspicuous opt-in mechanism, such as an unchecked checkbox or equivalent action, and must not be pre-selected or hidden within other agreements.
Merchants using Orange Send must ensure that any SMS messaging programs they operate comply with all applicable laws and industry standards.
You retain ownership of your customer data. Orange Send processes customer data solely on your behalf to provide the Service. You are the data controller, and Orange Send acts as a data processor.

Use of the Service may require payment for credits, subscriptions, phone numbers, or registration fees. All fees are non-refundable unless required by law.
We may suspend or terminate your account at our discretion if you violate these Terms, fail to pay fees, or engage in behavior that results in complaints, carrier violations, or legal risk.
The Service is provided "as is" without warranties of any kind. We do not guarantee message delivery, uptime, or uninterrupted service.
To the maximum extent permitted by law, Orange Digital LLC shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
